Tiffany Payne was arrested on Tuesday at her Bay Point home and charged with criminal threats, including unlawfully firing a handgun with gross negligence, intentionally injuring a child, and a criminal enhancement for using a weapon to commit a crime.
The incident happened on August 29 in Berkeley’s Strawberry Creek Park neighborhood, according to Berkeley Police. A woman named Tiffany Payne allegedly approached a 5-year-old boy on the 2200 block of Bonar Street and began bothering him.
After interviewing witnesses and reviewing surveillance footage from the area, investigators identified the suspect. On November 29, detectives apprehended the suspect after serving a search warrant at her Bay Point House. They also discovered a loaded handgun that had been stolen during an Oakland robbery.

Payne admitted to the shooting on Berkeley’s Bonar Street, according to court documents. Hercules Police Department was also looking for her on a different handgun possession charge.
She was arrested and charged with Unlawful Firearm Discharge. Under ARS 13-3107, illegally discharging a firearm is a Class 6 felony. The individual must have fired a weapon with criminal carelessness within the boundaries of a municipality.
She was later charged with making criminal threats, including recklessly using a gun, intentionally injuring a child, and committing a felony while in possession of a firearm.
The incident occurred in a driveway between two apartment complexes flogging Strawberry Creek, according to Berkeley Police. There were several children present when the shooting occurred, and the gunfire could have injured them.
