Breyer attended Stanford University before enrolling as a Marshall Scholar at the University of Oxford and receiving his law degree from Harvard in 1964.

The judge served as a law professor and lecturer at Harvard Law School from 1967 to 1980 after completing a clerkship with Associate Justice Arthur Goldberg in 1964–1955. In addition, he wrote textbooks on administrative law that are still in use today.
